International Students
Our firm specializes in providing legal assistance to international students. In recent years the opportunities for students to work and live in Canada have grown considerably. At ATAC Law we ensure that our international student clients are able to enjoy all of the opportunities Canada has to offer them.
Studying in Canada is an excellent way to acquire work experience and eventually immigrate to Canada.
ALL students who graduate from a designated University, College or public institution after at least eight months of continuous students are eligible to apply for a post-graduate work permit enabling them to stay and work in Canada up to three years after their study permit expires. There are very strict requirements to the PGWP application and they must be met in order to be approved.
An international graduate may gain permanent residence in B.C. and/or Canada through the BC Provincial Nominee Program, and/or Express Entry.
Meeting Immigration Canada’s deadlines, submitting supporting documentation, and generating points are all extremely important factors in whether or not an application will be successful. Legal assistance is strongly recommended.
International students not only enrich our schools, but also enhance our cultural diversity in Canada. At ATAC Law we guide and work with our international student clients through each stage of their immigration process to ensure that working in Canada and eventually immigrating to Canada are both possible.
Family Immigration and Family Class Sponsorship
Reuniting families is a large part of our practice at ATAC Law.
Family class sponsorships enable a Canadian citizen or permanent resident of Canada, who is eighteen or older, to sponsor a family member to immigrate to Canada. In these cases the minimum income threshold requirement is waived. Family class sponsorship applications are complex and usually very time consuming. They require applicants to demonstrate the genuine nature of their relationship with the person they are sponsoring through evidence. These applications are examined in great detail by Immigration officials and legal assistance is highly advisable. At ATAC Law we can help as we ensure our clients’ applications are correct, complete, and processed as quickly as possible.
Family immigration includes spousal sponsorships for spouses, common law partners, conjugal partners, dependent minor children and adopted children. It also includes super-visas for parents and grandparents. Very often an individual will apply for permanent residency through one of Canada’s economic programs, like Express Entry. Once in Canada, these permanent residents are able to sponsor their family members to immigrate to Canada through Family Immigration. We specialize in the beginning to end of this process.
Workers
At ATAC Law we assist clients in coming to work in Canada on both a temporary and permanent basis.
Express Entry
Express entry is the new process that enables skilled individuals to apply for permanent residency in Canada. There are four programs: Federal Skilled Workers, the Federal Skilled Trades program, the Canadian Experience Class and Provincial Nominee Programs. There are a number of steps that an applicant must take in order to determine whether or not they are eligible for these programs. Steps include having a language assessment, obtaining letters of reference from previous employers, and getting educational credentials evaluated. At ATAC Law we are able to assist in guiding potential applicants through this complex and complicated process. We are committed to ensuring that our clients’ applications receive the highest scores possible so they may be eligible to apply for permanent residency.
Work Permits
Canada has a shortage of both skilled and unskilled workers in many different economic sectors. Accordingly, there are a number of temporary foreign worker programs that are available. Most of the time, an employer will need to demonstrate through what is class a Labour Market Impact Assessment that it has made attempts to hire a Canadian to fill the position and has been unsuccessful before it can sponsor a non-Canadian to come to Canada. There are, however, other programs like the Live-in Care Giver program that does not have this requirement. At ATAC law we are able to assist Canadian employers who are seeking to hire foreign workers through their process.
