Traffic Tickets and Traffic Violations

Did you receive a traffic ticket? We do not recommend paying it. If you pay it, you are admitting guilt and you will have to pay a fine, your insurance rates may go up, and you could even lose your license. It could cost you thousands of dollars.

The only way you can get out of paying is to dispute the ticket. You will be required to defend yourself in Provincial Court before a judge.

You will need to make legal arguments for why you should not be guilty of the offence. Appeals to emotion and reason will not work. For example, it is not an excuse that you have a clean driving record, or that you made a mistake. You must make legal arguments that prove that you are not guilty of the offence. Legal arguments could include:

  • You didn’t to the thing that you are being accused of (for example, you were not actually speeding, or you did not know you were prohibited from driving)
  • It was not you who did the thing you are accused of (for example, the police misidentified you)
  • You have a compelling defence for why you did the thing you’re accused of (for example, the road was not a “Highway”)

Ultimately, the police officer needs to prove his case against you “beyond a reasonable doubt.” This means that the police officer must prove all the elements of the case against you. If he forgets just one, then you could potentially get off of paying the ticket. You must point out which part of the offence the police officer forgot to prove in order to win.

If you are found guilty, then the penalty will be a fine of up to $2,300 for each offence and may include penalty points. Penalty points will eventually cause you to lose your license. In some cases, it takes only one ticket for an N driver to lose their license. In addition, ICBC will charge you additional premiums, even if you do not insure a vehicle. These premiums can add up to thousands of dollars (see ICBC’s Driver Penalty Point Premiums and Driver Risk Premiums).

The only way you can avoid these penalties is if you go to court and fight your ticket. Do not pay the ticket.
