ATAC LAW was engaged by a supplier of heating, ventilation and air conditioning equipment (HVAC) who was contracted with a mechanical contractor that went bankrupt. The mechanical contractor supplied the HVAC equipment to a development property and ATAC LAW placed a lien on the property. The lien was used to negotiate a settlement with the owner and general contractor on the basis that the holdback funds being held back from the mechanical contractor were sufficient to pay out the claim of lien. This resulted in a recovery of over 95% of the amount claimed by the HVAC supplier. This claim was settled without pleadings having to be filed.
