Builder’s Lien – Vancouver Construction Law Firm ATAC Law: Successfully Defended Owner Against Claims from Subcontractors

Successfully Recovered $200k in Extras Claim

ATAC LAW acted on behalf of an owner developer of a property in Vancouver wherein a general contractor was terminated for breach of contract and failure to pay sub contractors. Over half a dozen subcontractor’s placed liens on the property in an amount exceeding $200,000.00. A number of them filed actions to enforce their liens.

ATAC LAW negotiated with the sub contractors and relied on the builder’s lien holdback under the Builders Lien Act to reduce the total amount of the owner’s liability to 10% of the amounts paid to the general contractor. This strategy resulted in savings to the owner of over $100,000.00 and dismissal of a number of the subcontractor’s claims.

ATAC LAW also obtained the dismissal of a number of claims from subtrades who filed claims in small claims court. Without filing a builder’s lien on a property and commencing an action in supreme court, a subcontractor cannot claim against a holdback or against an owner of property even if the subcontractor worked on that property and was unpaid.
