An Owner hired a general contractor for the construction of a professional office. The general contractor made a number of representations about price and schedule and incorporated those representations into a contract. When the work was complete, the general contractor made claims against the Owner for additional costs in the amount of $80,000.00.

This was a case that was relatively easy to resolve primarily because there was a clear written contract with a budget and a schedule. The contract stated that the work was for a fixed price with allowances on specific items. Because the general contractor was making claims for extras with respect to items that were fixed price, the Owner was able to rely on the contract to resist any claims for extras.
