Expert Guidance for Students Facing Academic and Non-Academic Misconduct Accusations
At ATAC LAW, we understand how overwhelming it can be for students facing allegations of academic or non-academic misconduct. These cases can have serious consequences for your academic future, career prospects, and reputation. Our experienced team has successfully represented students from top universities and colleges across British Columbia, including Simon Fraser University (SFU), The University of British Columbia (UBC), and Trinity Western University (TWU).
We provide comprehensive legal support to guide students through every stage of the disciplinary process, from the initial investigation to hearings and appeals.
Our Services
We assist students in matters involving:
Academic Misconduct
Allegations of plagiarism, cheating, or other academic dishonesty.
Non-Academic Misconduct
Accusations including breaches of university policies, including sexual harassment and sexual misconduct.
Academic Discipline Appeals
Advocacy at hearings such as the President’s Advisory Committee on Student Discipline (PACSD) and appeals to the Senate Committee on Student Appeals on Academic Discipline.
Academic Standing Appeals
Assistance for students contesting decisions related to probation, suspension, or expulsion due to academic performance.
The Consequences of Misconduct Findings
Universities and colleges impose serious penalties for academic and
non-academic misconduct, including:
- Re-taking exams, assignments, or midterms.
- Failing a course, with the requirement to re-take it.
- Suspension for one or more semesters.
- Expulsion, which can prevent you from obtaining your degree.
These penalties can jeopardize your ability to graduate, tarnish your academic record, and hinder future career opportunities.
Findings of non-academic misconduct, particularly those involving sexual harassment or misconduct, are even more severe as they may appear on your transcript and have lasting effects on your future.
How the
Process Works
The Complaint
The process typically begins with a complaint from a professor, advisor, or student. This complaint is reviewed by the institution to determine whether formal accusations will proceed.
The Formal Accusation
If the complaint advances, you will receive a written statement of the case against you, such as UBC’s Statement of Case. At this point, you must submit a Statement of Response or equivalent reply to the allegations.
Preparing Your Defense
This is where hiring a lawyer is critical. A comprehensive defense should include:
- A detailed written response.
- Supporting evidence.
- Appendices containing witness statements or other documentation.
The Hearing
You will appear before a committee or panel that will review your case. This is your opportunity to present your defense, question the evidence, and respond to invasive questioning. You are entitled to have a lawyer represent you during this hearing to protect your rights.
