Siwei Xu

Siwei Xu is a civil litigator at ATAC LAW who acts in the disputes that arise when a commercial or personal relationship breaks down, between landlord and tenant, employer and employee, spouses, or business partners. He represents individuals and businesses that need a matter resolved without unnecessary delay, defining the client's position early and advancing it through negotiation, settlement, or hearing, whichever concludes the matter soonest. His practice extends across property, employment, family, and commercial disputes, a breadth that lets him recognize where one overlaps with another, a separation that affects a family business, or a dismissal that follows a shareholder dispute.

Property matters run through much of his practice. He appears regularly before the Residential Tenancy Branch, representing both landlords and tenants in disputes over tenancy agreements, arrears, and possession under the Residential Tenancy Act. He also conducts builders lien claims under the Builders Lien Act and the construction disputes that underlie them, together with mortgage foreclosures and the boundary and encroachment claims that arise between neighbouring owners.

He is frequently engaged when a working or personal relationship reaches an impasse. In employment matters he advises on termination and severance, wrongful dismissal, workplace investigations, and the privacy questions that accompany them, acting for employees and employers in turn. In family matters he handles divorce and the negotiation and review of separation agreements under the Family Law Act, keeping the emphasis on a practical resolution rather than a prolonged dispute.

In commercial and financial disputes he brings and resists claims concerning loans, unpaid debts, and investments, shareholder and business disagreements, intellectual property, and contested estates. His work takes him before the Provincial Court and the Supreme Court of British Columbia, and into judicial review, including challenges to driving prohibitions. On every matter he determines what the documents and the law will support, identifies the most direct route to a result, and keeps the client informed of where the matter stands. Whatever is at stake, a home, a livelihood, a marriage, or a sum of money, his objective remains constant, an outcome on which the client can rely and act.
